About Homely Hands Healthcare
Homely Hands Healthcare, a brand under Homely Hands Healthcare Pvt. Ltd., provides independent health caregivers (“CareGivers”) for in-home personal care services (“Service”) for you or another person who is a parent or relative (“Patient”). Homely Hands Healthcare conducts background and experience verification of these CareGivers via an independent background verification company.
Customer Agreement
You, on behalf of the Patient, request Homely Hands Healthcare to provide Service at home or any other agreed location. You acknowledge that the Service is advised by a legal medical practitioner, and you accept responsibility for the Service and associated risks. While Homely Hands Healthcare ensures high-quality Service, it is not responsible for any Service errors, including criminal activities by CareGivers. You understand and agree that the Service offered by Homely Hands Healthcare, directly or through CareGivers/affiliates, carries risks, including potential mortality or permanent disability. Homely Hands Healthcare does not guarantee any specific recovery or outcome from the Service. You agree to provide a safe environment for CareGivers to perform their duties and ensure they are not harassed, abused, or troubled physically or emotionally. You authorize Homely Hands Healthcare to collect the Patient’s data and use/share it with others (without revealing the Patient’s identity). Homely Hands Healthcare is not responsible for the misuse of the Patient’s data by CareGivers, affiliates, employees, or other parties. Payments to Homely Hands Healthcare must be made as per agreed terms and are not linked to the outcome of the Service.
Scheduling Appointments
Appointments for Service with Homely Hands Healthcare can be scheduled through the Homely Hands Healthcare website, mobile app, or by calling +91-7792868164/ +91-9610778833. Your request for Service is accepted only when you receive a booking confirmation from Homely Hands Healthcare.
CareGiver Selection
Homely Hands Healthcare has a pool of CareGivers to choose from to provide the Service. Homely Hands Healthcare will strive to assign a CareGiver according to your preference, but this may not always be possible. Homely Hands Healthcare reserves the right to assign any CareGiver as deemed fit for the Service and does not guarantee the same CareGiver will be assigned on all days.
General Payment Terms
Payment can be made via cash, payment gateway, or cheque drawn in favor of Homely Hands Healthcare Pvt. Ltd. You agree to make payment as soon as the demand is raised. Homely Hands Healthcare reserves the right to cancel ongoing or future appointments if payments are not made on time.
Taxes: All charges and fees are exclusive of applicable taxes. Additional taxes will apply as per the rules.
Intellectual Property Rights
All intellectual property used on the websites by Homely Hands Healthcare, service providers, or any third party shall remain the property of Homely Hands Healthcare, service provider, or any other third party as applicable. You agree not to circumvent, disable, or otherwise interfere with security features of the website or features that prevent or restrict the use or copying of any materials. The Service is protected to the maximum extent permitted by copyright laws, other laws, and international treaties. Content displayed on or through the Services is protected by copyright as a collective work and/or compilation, pursuant to copyright laws. Materials on the websites or otherwise may not be modified, copied, reproduced, distributed, republished, downloaded, displayed, sold, compiled, posted, or transmitted in any form or by any means, including but not limited to electronic, mechanical, photocopying, recording, or other means.
Limitation of Liability
In no event shall Homely Hands Healthcare be liable for any special, incidental, indirect, or consequential damages of any kind in connection with these terms of use, even if the user has been informed in advance of the possibility of such damages. The total aggregate liability of Homely Hands Healthcare to a user or professional for all damages, losses, and causes of action (whether in contract or tort, including, but not limited to, negligence or otherwise) arising from this agreement or a user’s use of the website or the Services shall not exceed INR 100/- (Rupees One Hundred Only).
Information You Provide Homely Hands Healthcare
When you request a Service from Homely Hands Healthcare, you agree to provide personal information about yourself and the Patient, such as name, mobile number, date of birth, gender, weight, and relevant medical information about the Patient. You agree to provide accurate personal and medical information about the Patient, and failure to do so may result in adverse consequences in the delivery of Service. Homely Hands Healthcare may provide this information to the assigned CareGiver as deemed fit.
Customized Service and Payment Flow
Every patient is different. At Homely Hands Healthcare, upon receiving your request, we have a detailed conversation with you about your specific medical condition and then suggest the best course of action. Payment is requested only when you agree with our proposed plan of action and the costs involved. We can request online payments through SMS, email, website, or our mobile app, which also clarifies the details of your booking. We use third-party payment service providers to facilitate payment. Except in urgent situations, Service commences only upon receiving the payment.
Communications from Homely Hands Healthcare
You agree on behalf of yourself and the Patient to receive communications in the form of SMS messages, emails, and calls on your mobile number and email ID from both Homely Hands Healthcare and the assigned CareGiver. You agree to receive promotional messages in the form of newsletters, special offers, reminders, and updates.
Termination
Homely Hands Healthcare may immediately terminate the Service at any time for any reason, through notice sent by post to the registered postal address or email communication to the registered email address.
Choice of Law
These Terms of Use shall be governed by and interpreted in accordance with the laws of India. The place of jurisdiction shall be exclusively in Gurugram.
